OWNERSHIP STRUCTURE · EAST MONEY GUIDE

Buying property through a trust or company

The borrower, owner and guarantors need to be clear before a contract is signed. Trust and company ownership can change lending, legal, tax and future-sale consequences, so the advice and loan structure need to align.

East Money · General information

Choose the ownership structure before the contract

Changing the purchaser later can create legal, duty, tax or timing problems. Obtain qualified legal and tax advice on the intended owner before signing.

Map every party to the loan

A company, trustee, trust and individual guarantors can each have a role. The lender may request constitutions, trust deeds, amendments and identification for directors, trustees and beneficiaries.

  • Exact purchasing entity and trustee
  • Directors, shareholders and trust controllers
  • Proposed borrowers and guarantors
  • Existing related-entity debts and guarantees

Income and serviceability still need a clear path

The lender must understand how rent, business earnings or personal support will meet repayments. Entity financials and guarantor positions may be assessed together.

Lending options and costs can differ

Rates, fees, loan terms, lending ratios and product features may differ from lending to individuals. Compare the complete facility rather than assuming a residential product will apply.

Plan for future changes

Adding investors, distributing income, refinancing or selling may have consequences beyond the loan. The structure should support the longer-term purpose as well as the immediate purchase.

QUESTIONS PEOPLE OFTEN ASK

Useful points to clarify early.

Is a trust or company always better for investment property?

No. Suitability depends on tax, asset protection, land tax, finance, succession and personal circumstances. Obtain qualified advice.

Will the lender assess the directors personally?

Often, relevant directors or guarantors and their commitments are reviewed, but requirements vary by lender and transaction.

Can I change the purchaser after signing?

Sometimes, but it can create serious legal, duty, tax and finance issues. Seek advice before any change.
